Malta Consults on a New Framework for Aircraft Financial Leasing

The Malta Financial Services Authority (MFSA), together with the Malta Financial Services Advisory Council (MFSAC), has launched a public consultation on the introduction of a new regulatory framework for Aircraft Financial Leasing Companies.

The consultation, which is open until 9 February 2026, aims to modernise and streamline the regulatory treatment of aircraft and aircraft engine leasing activities carried out from Malta.

The proposed framework introduces a notification-based regime for qualifying lessors managing high-value aviation assets. Under the proposal, companies with assets exceeding EUR 100 million would no longer be required to obtain a financial services licence, instead operating under a simplified registration and oversight model administered by the MFSA.

Malta’s strong aviation ecosystem, international reputation for legal certainty, and compliance with the Cape Town Convention provide a solid foundation for this initiative. The proposed regime is designed to improve market accessibility, attract institutional investors, and reinforce Malta’s position as a competitive jurisdiction for aviation finance.

Malta has become an increasingly attractive jurisdiction for aircraft ownership and leasing, combining a well-established aviation ecosystem with legal certainty, regulatory credibility and strong protections for financiers. Its adherence to international aviation conventions, growing aircraft register and business-friendly structuring options have made it a practical choice for lessors, operators and investors alike. The proposed aircraft financial leasing framework builds on this foundation, signalling Malta’s intention to further simplify market entry while reinforcing its position as a competitive hub for aviation finance.
